If you are packing for your upcoming trip to the Mexican Caribbean, you need to remove one specific item from your suitcase right now.

As of January 16, 2026, federal authorities in Mexico have officially ended the “grey area” regarding electronic cigarettes (vapes). Under a sweeping reform to the General Health Law, bringing a vape into the country is no longer just a risk—it is a guaranteed way to lose money and time at the airport.

For years, travelers have gambled with the rules. Some got through; some didn’t. But after the new laws passed earlier this month, Customs officers in Cancun were given strict new orders: if they find it, they seize it—and you pay the price.

Here is what travelers need to know about the new enforcement wave.

The “Personal Use” Loophole Is Gone

The most common mistake travelers make is assuming that “Personal Use” protects them. It does not.

Under the new 2026 guidelines, the importation of any vaping device—regardless of whether it is for sale or personal consumption—is strictly prohibited.

The law does not distinguish between a massive box of disposable vapes intended for resale and a single JUUL pod in your carry-on. Both are classified as illegal contraband under the General Health Law.

The “Invisible” Scanner Trap

Travelers arriving in Cancun who remember the old “Red Light / Green Light” button will be surprised to see it is gone. Do not mistake this for a lack of security.

If you are walking toward the “Nothing To Declare” exit and an officer steps in front of you, it is not bad luck. It is because the backstage scanner already flagged your specific bag, and they were waiting for you to pick it up.

The Cost of Getting Caught

If you are flagged, the best-case scenario is that you lose your device. The worst-case scenario involves your wallet.

According to reports from travelers this week, administrative fines for “attempting to import prohibited items” are currently ranging from $200 USD to $500 USD.

This fine is often payable immediately at the terminal. If you refuse to pay or argue with the officers, you risk being denied entry into the country or facing temporary detention until the “administrative penalty” is settled.

Important Warning: If you are caught with multiple devices (for example, a carton of disposables for your friends), officers can classify this as “intent to distribute.” This moves the infraction from an administrative fine to a federal crime, which carries significantly harsher penalties.

Can You Buy Them In Cancun?

This is the confusing part for tourists. You will likely still see vapes being sold in downtown Cancun or by street vendors in the Hotel Zone.

Do not let this fool you.

The sale of these items is also illegal. These vendors are operating outside the law. While the police prioritize stopping the importation at the airport, buying one on the street puts you at risk of interacting with illicit sellers.

Is that “Puff Bar” worth a $200 fine and an hour of stress in a humid customs room?

The advice from travel experts is simple: Leave it at home.

Mexico’s anti-tobacco laws are now some of the strictest on the planet. Enjoy the beaches, enjoy the tacos, but do not let a $20 electronic device ruin the start of your vacation.

Is it worth it? Wow! What if you have spent years getting away from cigarettes to use a vape which is much better for your lungs. If you’re addicted to nicotine what are you supose to do?? Your vacation would suck! Headaches, being ill and cranky. This is ridiculous
